Agreement to Terms
By accessing or using the Resume Credibility website (resumecredibility.com) or requesting an audit (the “Service”), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the website or the Service. Resume Credibility is a service of 25 Fathoms, LLC (“we,” “us,” “our”), a New Mexico limited liability company.
Description of Service
Resume Credibility provides an advisory analysis of a resume you already hold, scored against a role you supply. We return a written audit — a fit score, a requirement coverage read, a verifiable-versus-unverifiable split, an AI-authorship read, tiered flags with the exact resume lines quoted, and interview probes — promptly after a completed request. The audit is our professional read of a document: signals with a stated confidence, never a final verdict on a candidate. Current tiers and limits are described at resumecredibility.com/pricing.
Service Tiers
The Service is offered as a single audit (one resume against one role), a shortlist ranking (multiple candidates scored on one consistent ruler), and a monthly recruiter retainer, as described on the Pricing page. One complimentary first audit is available per organization. Agency and volume rates are available for staffing firms. Every audit, at every tier, is produced on the same scoring framework; the tiers differ in volume and support priority. The recruiter retainer includes unlimited audits under a fair-use standard: it is intended for the ordinary screening volume of a single recruiting team, not for reselling, sharing across unrelated organizations, or automated bulk submission. If use substantially exceeds normal single-team screening, we may contact you to move the account to volume pricing before continuing.
Not a Background Check or Consumer Report
The audit is an advisory document. It is not a background check, a consumer report, or an investigative consumer report under the Fair Credit Reporting Act (FCRA) or any comparable federal, state, or local law, and it must not be used as one. We do not verify identity, run public-records searches, contact references, or make employment decisions. The audit reports signals, not verdicts, and never infers age, race, national origin, disability, or any other protected characteristic. You are solely responsible for your hiring decisions and for complying with the laws that govern them, including the FCRA and equal-employment-opportunity laws.
Shortlist Rankings and Automated Hiring Laws
A shortlist ranking scores each candidate against the same requirements, taken from the role description you supply. The ranking is an aid to your review; you decide who advances. Some jurisdictions, including New York City, Illinois, and California, regulate automated tools used in hiring and may require notice to candidates, a bias audit, or other steps. You are responsible for determining whether those laws apply to your use of the Service and for meeting them, including any notice to candidates.
Stated Job Requirements
The audit scores a resume only against requirements stated in the role description you supply. If a role description states a requirement tied to a protected characteristic that the law allows an employer to require in limited cases, such as a religious organization’s faith requirement or another bona fide occupational qualification, you represent that it is lawful for the hiring employer to require it, and the audit reports only whether the resume states it. We never infer a protected characteristic, and we may decline to score any requirement we believe is unlawful.
License
Subject to your timely payment of fees and your compliance with these terms, we grant you a non-exclusive, non-transferable, revocable license to use each audit we deliver as an input to your own hiring process. You may not resell, sublicense, publish, or redistribute an audit outside that process, and you may not reverse engineer, decompile, or copy our scoring framework, templates, or the audit format. We retain all rights in our methodology and materials. You may present an audit to the hiring employer under your own name or brand; if you do, you remain responsible for any disclosure to candidates that applicable law requires.
Account and Submission Responsibilities
You are responsible for the accuracy of the material you submit and for the activity of anyone you allow to use the Service on your behalf. You represent and warrant that, for each resume and role you submit, you have the right to share it with us and to have it analyzed, and that you have given the candidate any notice that applicable law requires. You will keep your billing and contact information current so audits and service notices reach you, and you will notify us promptly of any suspected unauthorized access.
Acceptable Use
You agree not to use the Service to violate any applicable law or regulation; transmit malicious code; interfere with the operation of the Service or another customer’s use of it; misrepresent your identity or your authority; submit fabricated material or a resume you are not authorized to share; use an audit as the sole basis for an adverse decision; or use the Service to infer, or to act unlawfully on, age, background, or any other protected characteristic.
Third-Party Services and Subprocessors
The Service depends on third-party platforms. Current subprocessors include Stripe (payment processing), Anthropic (the AI model provider used to help produce the audit), and our hosting, file-storage, and email-delivery providers. Each processes data only to provide its service to us, and our AI provider account is set so your material is not used to train its models. Your use of any subprocessor’s interface is also subject to that subprocessor’s terms. We will give at least 30 days advance notice before adding or replacing a subprocessor that processes customer data.
Customer Data and Ownership
You own the resumes and role descriptions you submit and the audits we deliver to you. We process that material only to provide the Service to you. We do not sell it, and we do not use it to train external machine-learning models. Resumes, role descriptions, and the audits we produce are deleted or de-identified within 90 days of delivery, or sooner on your request. We keep a record of each request, without candidate content, for billing and service. Backup copies held by our providers age out under their retention policies. A data processing agreement is available on request. Our handling of personal information is described in our Privacy Policy.
Payment, Renewal, and Refunds
Fees are shown on the Pricing page and charged through Stripe. Single audits and shortlist rankings are charged at the time of request; because each is custom work delivered quickly, they are non-refundable once delivered, and if we are unable to deliver a completed request we will refund it in full. Retainers are billed monthly in advance, auto-renew each month, and may be cancelled at any time effective at the end of the current billing period; they are not prorated for a partial month. Prices may change with at least 30 days notice. Fees paid in advance are otherwise non-refundable except where required by law. You are responsible for any applicable taxes.
Intellectual Property
Resume Credibility, including the name, marks, software, scoring framework, audit format, and any content libraries we author, is the intellectual property of 25 Fathoms, LLC. The Resume Credibility name and the tagline “Know what a resume can actually prove.” are trademarks of 25 Fathoms, LLC. Nothing in these terms grants you any right to use our marks without prior written consent. We may create anonymized sample audits that contain no information identifying any real candidate.
Confidentiality
Each party will protect the other party’s confidential information using reasonable care and will not disclose it except to employees and contractors with a need to know who are bound by similar obligations. The material you submit and the audits we deliver are your confidential information. The Service and its non-public methodology and features are our confidential information.
Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted or error-free. The audit reflects our professional judgment about a document; we do not warrant that a candidate’s claims are true, that a flagged item is a fabrication, or that any hiring outcome will follow. The audit is for screening and reference only. It is not legal advice and does not replace your own judgment or your obligations under employment law.
Limitation of Liability
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption. Our total liability for any claim arising out of or relating to these terms or the Service will not exceed the total fees paid by you to us in the twelve (12) months preceding the event giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless 25 Fathoms, LLC, its officers, employees, and contractors from any claim or demand arising from your violation of these terms, your violation of any law, your infringement of any third party’s rights through your use of the Service, or your use of an audit in a hiring decision.
Termination
Either party may terminate for material breach with 30 days written notice and an opportunity to cure. We may suspend the Service immediately for non-payment, security risk, or violation of the Acceptable Use section. Upon termination, your access to the Service ends, material you submitted is deleted per the Customer Data section, and prepaid fees for the remainder of the term are non-refundable.
Changes to Terms
We may modify these terms from time to time. Material changes will be posted on this page with an updated revision date and, where the change affects an active customer, communicated by email at least 30 days in advance. Continued use of the Service after the effective date of a change constitutes acceptance.
Governing Law and Venue
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. The parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Hamilton County, Ohio, for any dispute the parties cannot resolve informally.
